The division bench comprising Chief Justice J S Khehar and Justice A S Bopanna dismissed the PIL filed by B S Budhihal, a city-based advocate challenging the present condition of higher primary schools, which were upgraded upto eight standard under the scheme.

The petitioner in his submission, said that in 2009, 5,545 schools had been upgraded under the scheme, but the government did not appoint the qualified teachers to the said schools.

The existing teachers are not qualified to teach Biology, Social Science and language subjects. He submitted that implementation of the scheme by upgrading it without required experts will be detrimental to the project.

Dismissing the petition, the court observed that the petitioner has failed to submit the relevant documents to justify his petition.
