HC extends order barring Nikon from cautioning Flipkart shoppers

 The High Court on Tuesday extended its interim order that restrained Nikon India Private Limited from displaying a caution notice on its website about buying its products on e-tailer Flipkart.

Flipkart has filed a Miscellaneous First Appeal before the High Court, seeking an injunction barring Nikon from displaying a caution notice on its website that consumers must look for warranty while buying its products on Flipkart. The e-commerce giant argued that Nikon cannot put up such a caution notice and that it cannot “discriminate against” Flipkart as its products are sold on other online shopping portals too. Flipkart sought the court’s directive to Nikon to not only remove the caution notice but also give a written undertaking that such notices will not be displayed in future. Nikon countered Flipkart by arguing that its appeal was not maintainable on merit.

Flipkart field the appeal before the High Court after a lower court rejected its application for an injunction against Nikon. Justice B S Patil extended the interim order and adjourned the hearing until Wednesday.
