HC notice to Centre on 'inflated' sales by BEML

Petitioner K Subramanya Sastry had alleged the company cheated the office of the President of India who holds majority shares, by declaring inflated sales.

He had sought directions to CBI and Serious Fraud Investigation Office to prosecute the managing director and other authorities concerned.

Earlier this month, the Division Bench headed by Chief Justice J S Khehar dismissed a petition by Sastry seeking prosecution of the officers.

The Bench had noted that prayers of such nature could not be entertained under Article 226 of the Constitution and the petitioner may seek suitable directions by filing an appropriate petition under Section 482 of the CrPC.

The petitioner had alleged that the company declared inflated sales of Rs 677.25 crore for the year 2009-2010 and Rs 538.88 crore for the year 2010-2011. Justice K N Keshavanarayana ordered notice.
