HC orders release of detainees

Hearing a habeas corpus petition by Noorjahan, a resident of Mandimohalla, Mysore, the division bench comprising Justices V Gopalagowda and K Bhaktavatsala ordered the release of all persons remanded in judicial custody by the tahsildhar, Mysore. The bench said that the arrested should be released unless they were required in some other criminal case. However, following the submission of a confidential report from the Police Commissioner, Mysore, the bench said that the police can proceed in accordance with law, if necessary.

The petitioner had filed a habeas corpus petition seeking to produce 113 persons detained during the riots. She had alleged that despite securing bail, some of them were not released and instead shifted to Belgaum Central Prisons. The division bench had directed the State to file a reply observing that as per rules a person cannot be detained for more than 24 hours.
