HC refuses to hear State's plea

The division bench comprising Chief Justice P D Dinakaran and Justice V G Sabhahit refused to stay the order saying that they cannot do it as the Apex Court itself has not stayed it.

Acting Advocate General, Ashok Harnahalli earlier said that the Supreme Court will be taking up the matter after vacation and sought for a stay till mid-July on the single judge order.

However, K V Dhanajaya, counsel for the educational institutes said that the respondents (State) had violated the deadline and declared that they will not implement the order. Therefore a contempt petition has been filed against the State.

The bench, which sought the status of the contempt petition said that it cannot interfere with the matter.

The counsel said that Friday was the last date to file objections and alleged that this appeal is just an effort to evade the contempt proceedings. The bench directed that the matter be placed before the bench dealing with the contempt case.
