The Supreme Court on Monday stayed the Karnataka High Court’s order setting aside the 2008 election of BJP MLA for KR Puram constituency N S Nandisha Reddy.

A vacation bench of Justices K S Radhakrishnan and J S Khehar issued notices to the Election Commission and Kavitha Mahesh, Independent, who had challenged the poll for “improper” rejection of her nomination papers.

The HC had on June 1 allowed the petition filed by Kavita Mahesh and declared the election held on May 10, 2008 to the Assembly constituency in Bangalore Urban district as void.

Challenging the order, senior advocate Gopal Subramaniam submitted that the HC order had raised several legal issues.

Allowing the petition by Kavita Mahesh, Justice D V Shylendra Kumar of the High Court had also directed the court registry to register a case against the returning officer for allegedly giving false evidence.
