Justice Sanjay Kishan Kaul on Thursday said the right to privacy can “unequivocally” be a fundamental right but subject to restrictions.

“This is the call of today. The old order changeth yielding place to new,” Justice Kaul added.

In his judgement that agrees with the others in the nine-judge bench, Justice Kaul said privacy is one of the most important rights to be protected from both state and non-state actors, especially in an era where there are wide, varied social and cultural norms.

This is more so in a country like ours that prides itself  on its diversity.

Privacy allows individuals to make autonomous choices, he added while stressing on the need for data protection.
