SC notice to Maharashtra Deputy Speaker, others over plea by Sena rebels against disqualification notice

Supreme Court issued notice to Deputy Speaker, Secretary of Maharashtra State Legislative Assembly, Centre and others on pleas filed by rebel MLAs against the disqualification notice issued by the Deputy Speaker Narhari Zirwal against Eknath Shinde and 15 other rebel legislators. SC also issued notice to Shiv Sena leaders Ajay Chaudhary, Sunil Prabhu and asks them to file a reply within five days. SC listed the plea for hearing on July 11th.

Senior advocate Neeraj Kishan Kaul appearing for Eknath Shinde and others tells the Supreme Court that the Deputy Speaker cannot proceed with the disqualification proceedings when the resolution seeking his removal is pending.

What is sought to be done in this matter is undue haste, violation of principles of natural justice. Kaul shows Article 179 of the Constitution which provides for removal of Speaker and Deputy Speaker.

Eknath Shinde is now minister-without-portfolio

Launching the first strike against the Eknath Shinde-backed group, Maharashtra Chief Minister Uddhav Thackeray on Monday stripped the rebel ministers of their portfolios and relocated to other council-of-ministers.

Shinde’s portfolios of Urban Development and Public Works (Public Undertakings) has been allocated to Shiv Sena veteran Subhash Desai, while Gulabrao Patil’s Water Supply and Sanitation portfolio has been handed over to Anil Parab.

It was a guarded stand of the Maha Vikas Aghadi as the portfolios have been stripped and they will now be minister-without-portfolio now.

The majority of the legislative party appointed Eknath Shinde as the Chief. Then the minority faction which has 19 MLAs now made Ajay Choudhari as their Chief in a quiet meeting. They inform the Deputy Speaker, and then Choudhari is declared. The majority faction wrote to the deputy speaker about their decision. Then the rebel MLAs get a notice to report to a meeting, by the minority MLAs. When the MLAs do not attend, based on the notice issued on same day, a disqualification is filed: Kaul tells SC

But the deputy speaker cannot proceed while there is no-confidence motion pending, Kaul says.

"The atmosphere right now is not conducive. I am respectfully saying, if there is not a constitutional bar, if there is discretion, then I would submit that disqualification, notice for barring hearing on the same, all have been dealt with under Article 32. The SC has said it is impermissible for the deputy speaker to decide on the disqualification petition till the no-confidence motion against him is decided," Kaul tells SC

PIL filed against Eknath Shinde and other rebel Shiv Sena MLAs in Bombay High Court for "neglecting" their official duties and seeking directions to them to resume office.

A group of activists and civil society members have moved the Bombay High Court seeking directions to the Shiv Sena rebel group of Ministers and MLAs to "return to the state (Maharashtra) and assume their duties", here on Monday.

The petition has been filed by crusader-lawyer Asim Sarode on behalf of the activists group, comprising prominent personalities from different fields.

Among other things, he has urged the court to direct the rebel group leader Eknath Shinde "who is on unofficial leave" along with other ministers to return to the state and take charge of their duties

The rebel Shiv Sena camp has a very unique mix comprising die-hard followers of Balasaheb Thackeray and fiercely loyal Shiv Sainiks and also more than a dozen who have switched parties.

The rebel camp has representation from all the five regions - Mumbai-Konkan, Western Maharashtra, North Maharashtra, Marathwada and Vidarbha.

Eknath Shinde dials Raj Thackeray amid deepening political crisis

Rebel Shiv Sena MLA Eknath Shinde spoke to MNS chief Raj Thackeray over phone twice amidst the ongoing political crisis in Maharashtra, according to ANI.

Shinde spoke to Thackeray about the recent political situation in Maharashtra and enquired about his health, an MNS leader confirmed the agency.
