Plea by Parsi woman goes to Constitution bench

SC bench refers the matter after acknowledging the question's importance

The Supreme Court on Monday referred to the Constitution Bench the question of a Parsi woman’s identity after her marriage to a man of a different faith.

A three-judge bench headed by Chief Justice Dipak Misra said it is “appropriate” to refer the matter to the five-judge Constitutional bench, given its importance.

The court posted the case for consideration to the Constitution bench, which is said to hear a batch of petitions from October 10. Senior advocates Indira Jaising and Sidharth Luthra asked if the question of a woman’s religious freedom guaranteed by Article 25 of the Constitution automatically ceases after she marries a man from a different faith.
