The Supreme Court on Friday turned down a plea of 9 disqualified MLAs of the Uttarakhand Assembly to participate in the Confidence Vote on May 10.

A bench of Justices Dipak Misra and Shiva Kirti Singh said it would be “inappropriate” to allow the rebel Congress party legislators to participate in the special session to be convened on Tuesday under the court’s supervision.

Senior advocate C A Sundaram, appearing for the disqualified MLAs, contended that their votes can be put in sealed cover, which can be counted as and when the pending disqualification proceedings were decided.

“The list (matter) is not before us. That (allowing disqualified MLAs to vote) would be inappropriate. The President’s Rule and the speaker’s decision in 10th schedule of the Constitution are two distinct things,” the bench said.
