The Supreme Court on Monday trashed a plea to decide upon itself the legal issue raised in two petitions pending in the Allahabad and Delhi High Courts challenging the nomination of cricketer Sachin Tendulkar to Rajya Sabha.
A three-judge bench led by Chief Justice Altamas Kabir declined to entertain the petition filed by former Delhi MLA Ram Gopal Singh Sidodia.
A counsel, appearing for Sisodia, submitted that there was likelihood of conflicting verdicts from the two high courts in the matter. So, the apex court should transfer both the petitions.
The Bench, however, was not impressed and dismissed the petition.
Tendulkar, nominated in the category of social service, took oath as an MP on June 4.
Sisodia had relied upon Article 80 (3) of the Constitution to claim that only a person having a special knowledge and practical experience in the field of literature; science, art or social service can be nominated to the upper house.
