The Supreme Court on Monday dismissed a petition demanding criminal prosecution and initiation of contempt proceedings against a member of the Special Investigation Team (SIT), which investigated the Ishrat Jahan alleged fake encounter case in Gujarat.
A three-judge bench presided over by Justice H L Dattu refused to admit a plea by Gopinath Pillai, father of Pranesh Pillai alias Javed Sheikh, who was among the four killed in the encounter on the outskirts of Ahmedabad in June, 2004.
The bench, also comprising Justices M Y Iqbal and S A Bobde, said that the petition was premature and that Pillai should wait for some more time to see if the CBI takes action based on his complaint.
Senior advocate Colin Gonsalves, appearing for Pillai, sought actions against SIT member Mohan Jha for allegedly seeking to dissuade witnesses in the case from making incriminating depositions.
