A student making wrong claim on eligibility criteria cannot blame his college for failing to verify facts, in a situation that prompts the university to cancel his admission, the Supreme Court has said.
A bench of Justices P Sathasivam and J S Khehar said the college cannot be held responsible for the mistake committed by the student.
“It has to be kept in mind that every candidate applying for a particular course in any college is expected to go through the advertisement thoroughly, including the eligibility criteria prescribed for each course and after fulfillment of the required conditions, state the correct particulars in the application form failing which he/she cannot claim any benefit for his/her own wrong,” the bench said.
The apex court quashed concurrent orders by a division bench and a single judge of the Allahabad High Court, directing Noida-based Priyadarshini College of Computer Science to pay Rs 5 lakh compensation to Manish Kumar whose admission to BTech course was cancelled by Uttar Pradesh Technical University after noting that he had not obtained minimum 60 per cent marks in qualifying subjects.
After going through the facts of the case, the court said Kumar had secured only 56 per cent marks in the qualifying level examination.
