A bench of Justices G S Si­nghvi and A K Ganguly also expressed surprise over the difference in the computation of lo­­sses by the CBI and CAG in the case.

“We are really surprised ov­er the communication. It was cr­eated as an autonomous regulator. It is a serious debatable issue what they have done and stated in recent days,” the court said. The Bench made the observations while hearing the arguments advanced on behalf of the CBI to oppose the applic­a­tion of Janata Party president Subramaniam Swamy for including then Finance Minister P Chidambaram in the 2G pr­o­be.
