The High Court issued notice to the government to respond to the petition within three weeks and posted the next hearing for mid-December, said Arvind Raghavan, the secretary of the Karnataka Racehorse Owners Association.
“In our petition, we have raised the plea that the original government grant has allowed us to continue to be in possession of the present premises as long as racing activity is conducted there,” Raghavan told Deccan Herald.
“We have no problems in shifting provided we are given adequate land, provided the land is not under dispute and provided we are given enough time to get the infrastructure in place,” Raghavan added.
“The High Court has consequently issued a notice to the State government and sought their response.”
A writ petition had initially been sought to be submitted in the Supreme Court, contending that the Chikkajala-Doddajala land was on a tank-bed and therefore could not be leased to the BTC.
The Supreme Court disposed of the petition while giving liberty to the petitioner to approach the Karnataka High Court.
Monday’s developments mean the BTC and the State government are in court, engaged in a legal battle, as it were.
