<div>A case of encroachment upon a civic amenity site and a Rajakaluve by a builder at Classic Orchards on Bannerghatta Road, which was directed for action against the officers involved by the Lokayukta investigation wing, has now been 're-referred' to the Technical Audit Committee (TAC) of the Lokayukta for investigation.<br /><br />The case pertains to Aastha Valmark, an apartment by Nakoda Constructions coming up inside the Classic Orchards, a BDA-approved layout. The layout residents claim that the builder fudged revenue documents to obtain all necessary clearances by various government agencies.<br /><br />Subbu Hegde, president, Classic Orchards Property Owners Association (COPOA), had lodged a complaint with the Lokayukta on December 30, 2014, stating that the builder used a fraudulent sale deed to encroach upon a government land in Survey Number 176/1. The COPOA had even approached the Deputy Commissioner, but their plea was ignored. He stated that Nakoda Constructions used a fabricated sketch of Survey number 86/2 to hide encroachment of government land. <br /><br />He said that the builder blocked and encroached upon a Rajakaluve in Survey Number 86/3. “Nakoda Construction Limited has got the plan for Aastha Valmark approved by the BBMP by quoting Survey numbers 86/2 and 178/1, instead of Survey numbers 176/1 and 86/3, using a fraudulent sale deed with Amalgamated Property Developers,” said Hegde in his complaint. The matter was referred to the TAC headed by Anil Kumar. Hegde said that BBMP surv eyor Achar had confirmed suppression of Survey Number 176/1 and closing and encroachment of the Rajakaluve. <br /><br />Subsequently, Anil Kumar sought an explanation from Govindaraju, the BBMP engineer in the Town Planning division, for not doing a proper verification, by June 10, 2015.<br /><br />On July 20, the investigation was closed with a recommendation to initiate action against the officers involved. However, five days later, the case was reopened for fresh investigation and it was ‘re-referred’ to the TAC. Anil Kumar, Chief Engineer of TAC-Lokayukta, told Deccan Herald that he was waiting for a response from the Town Planning division of the BBMP, without which the investigation would not be completed.<br /><br />Report sought<br />When contacted, BBMP Commissioner G Kumar Naik admitted that the representatives of COPOA had called on him and apprised him of the situation. “I have asked the Town Planning section to expedite the investigation and submit a report.”<br /><br />Mahavir Gulecha, one of the directors of Nakoda Constructions, refuted COPOA’s charges, stating that the residential complex was coming up in accordance with the law.<br /><br />Questioning the motives of COPOA, he said, “Do you think the government departments are sleeping? The complainants are free to approach anybody, but our stand is very clear: Whatever is done is legal and plans have been approved accordingly.”<br /><br />Subbu Hegde said that the Assistant Registrar of Enquiries-1 (ARE-1) of the Lokayukta did not entertain their plea to refer the matter to the Lokayukta police, which is a matter of concern.<br /></div>
