<p>Bengaluru: The <a href="https://www.deccanherald.com/tags/karnataka-high-court">High Court of Karnataka</a> on Thursday declined to stop the 'Cauvery Aarati' programme at Sankey Tank on Friday. </p><p>A division bench of Chief Justice NV Anjaria and Justice KV Aravind disposed of an Interlocutory Application (IA) after recording the assurance placed by Advocate General K Shashikiran Shetty and senior advocate Uday Holla, appearing for the BWSSB, that the event will be held in accordance with law. </p><p>"The authorities shall, while conducting the event, ensure that the public movement and public order is managed to maintain law and order and further that the provisions regarding the prohibitory acts in the tank, as provided under Section 12 of the Karnataka Tank Conservation and Development Authority Act, shall be observed," the bench said. </p>.Petition filed in Karnataka High Court to stop Cauvery Aarti on March 21.<p>The IA was filed by Bengaluru-based advocate Geetha Misra in a pending PIL petition on various issues, including encroachments and maintenance of lakes in the city. </p><p>The IA sought directions to the authorities to stop Cauvery Aarati and all related construction activities, either temporary or permanent, within the waterbody or the buffer zone of Sankey Tank. </p><p>GR Mohan, counsel for the applicant, submitted that he is not against Cauvery Aarati, but concerned about the constructions put up within the tank premises and its buffer zone. He further submitted that the tank is managed by the BBMP. </p><p>However, senior advocate Uday Holla submitted that similar programmes were held in the past and said that the event is being organised on World Water Day to create awareness about water conservation, for which there are provisions in the statute itself. </p><p>At the hearing, the bench deprecated the petitioner after going through the averments in the IA. It noted that while the prayer is addressed to the BWSSB, the agency is not a party in the main writ petition nor it was impleaded in the IA. The bench said the IA was filed in a casual fashion. </p><p>"The pleadings in the application are too cursory to be countenanced. The application is casually filed without prayers, looks like a telegram sent to the court. Not only that, there is no substantiation of the allegations made except production of photographs and newspaper reports. Filing of such an application is to be deprecated," the bench said.</p><p>"In any view, since the issue of ecosystem surrounding the Sankey Tank is raised, the court permitted the applicant to make submissions." </p>
