Complainant told to cough up Rs 6,000 as costs

Arvind Toshniwal had booked seats on Kingfisher Airlines from Bangalore to Nagpur on December 19, 2009.

However, he was informed by the Airlines on December 4 that the flight had been cancelled due to technical reasons. The money paid was refunded in full and he was even offered an alternative route for the journey.

However, Arvind decided to fly another airline paying an additional sum of Rs 9,394. He approached the consumer forum claiming compensation for inconvenience, loss etc.

The Airlines submitted that it has refunded the money in full and informed the customer well in advance on cancellation of the flight. It claimed that there was no deficiency on its part, and the consumer has not been put into any loss or harassment. It contended that the complainant was guilty of suppression of material facts of the case.

The Forum found the airline not guilty of deficient service and ordered the complainant to compensate the airline within 15 days for the inconvenience caused by his false complaint.

Borrower fined

The IV District Consumers Forum has directed a borrower of Axis Bank Limited, Koramangala branch to pay Rs 3,000 as costs to the bank.

Kumar Gaurav had approached the Forum alleging that the bank harassed him and seized his car in spite of payment of all monthly installments towards the vehicle loan.
The bank established that the borrower defaulted in payment of monthly installments and hence the vehicle was seized and sold n public auction.

The Forum ordered the complainant to costs to the bank.

Bag lost on flight

Anand Goenka had a filed a complaint alleging that despite having a ‘Senator’ status for travelling on Lufthansa airline, he was intimidated on his trip from Bangalore to Montreal without giving food he had asked for.

One of his bags was lost on arrival and returned later causing him inconvenience. The Forum has ordered the airline to pay Rs 9,814 towards the lost bag and Rs 5,000 for mental trauma and inconvenience.

Defective travel bag

Jitender Singh purchased a travel bag for Rs. 5,775 from Elite Brands Pvt. Ltd. The product had a one year warranty. But the bag's zip was tight and was not smooth for use.

The lock was not working, the wheels were defective and the bag could not be pulled easily. He returned the bag to the shop which could not repair it and promised to refund the amount but failed to do so despite several requests.

He complained to the IV Forum which ordered the shop to refund Rs 5,775 to him with costs of Rs 1,000 and another Rs 1,000 as compensation. The firm claimed that it had returned the bag, but was unable to establish the contention.
