Chinese mistress files case against lover's wife after paying 1.2 mn yuan 'divorce fee'

A Chinese mistress has filed a petition in a court against the wife of her lover to whom she had paid a 'divorce fee' of 1.2 million yuan.

The legal wife had refused to divorce her husband after which the mistress decided to file a lawsuit which was rejected by the court.

According to a report by the South China Morning Post, a man surnamed Han who was from Fujian province had married Yang in December 2013 and had two daughters with her.

Later, Han started having an extra-marital affair with his colleague Shi with whom he has a business partnership.

After Han welcomed a son with Shi in November 2022, the mistress confronted Yang and offered her a deal to pay her 2 million yuan if she agrees to divorce her husband.

According to the publication's report, to initiate the deal, Shi paid Yang 1.2 million yuan by the end of 2022, but even after a year, Yang neither divorced Han nor returned the money.

Frustrated by this, Shi filed a petition alleging that the two women had a 'verbal agreement' and requested the court to order Yang to return the money along with interest as a breach of contact.

Shishi People's Court rejected Shi's petition saying that her act of paying money violated societal moral standards, public order and has also disrupted a lawful marriage.

It also considered that though Han and Yang had signed a divorce agreement, but both were still in a 'colling-off period' concluding that Yang wasn't obligated to pay a refund.

According to SCMP, the court also revealed that during his marriage with Yang, Han spent about 6 million yuan on Shi without his wife's knowledge.

A lawyer from Henan Yushun Law Firm, Yue Zengchao discussed that the court is not likely to agree with Shi's request if the couple is not divorced.

According to SCMP, the lawyer said, "Any significant assets acquired by a married man during the affair, without his wife’s consent, are considered jointly owned by the couple. The wife has the legal right to demand the return of her share from the third party."
