Petitioners Nagaraj and others, residents of Chitradurga, have moved the HC challenging the notification dated August 28, 2009 stating that autorickshaws with two-stroke engines will not be registered by the Transport Department.They have stated that State has no powers to prohibit two-stroke engines, as it is the domain of the Central government.
Counsel for petitioners B R S Gupta in his submission said the intention of the government is not bonafide, as it has issued the notification twice and has also withdrawn it.
He said the government cannot decide on the fuel, as a vehicle can run either on diesel, petrol or CNG. The government cannot make a specific type of fuel as mandatory, they argued.
