Youth gets 10 years for kidnapping, raping child

A youth has been jailed for ten years by a fast track court here for kidnapping and raping a 10-year-old girl in a garden near her house in 2011.

Additional Sessions Judge M C Gupta, who is presiding over the fast track court set up to deal with cases of sexual offences against women, awarded the rigorous jail term to 22-year-old Sunny. The court also imposed a fine of Rs 15,000 on Sunny, a resident of Mahavir Vihar in north west Delhi.

The judge said it stands established that Sunny was involved in sexual intercourse with the minor without her consent. “The testimonies of the prosecutrix and her mother are found to be clear, cogent, reliable and having a ring of truth. There is nothing in their statements to suggest that they had any animus against the accused to falsely implicate him in the case,” the court said.

According to the prosecution, Sunny, who was known to the girl, kidnapped her on May 23, 2011 and took her to a garden near her house and raped the class 4 student.

When the girl’s parents, working as labourers, came home, their younger daughter told them that a boy had forcibly taken away the victim and they all started looking for her, it said.
On reaching the said garden, the girl's parents found that the accused was sexually assaulting their daughter and seeing them, he fled from there, it said. Police was called and later on the accused was arrested.

During trial, Sunny, who is married, claimed innocence.
