19-yr-old city youth gets bail in rape case

A 19-year-old youth facing trial in a rape case has been granted bail by a Delhi court on the ground that the woman changed her statement during deposition before it and police.

Additional Sessions Judge Rajender Kumar Shastri granted bail to the youth after the 39-year-old woman admitted that she had lodged a false case against the accused at the behest of her husband.

The judge also warned the woman that an adverse order could be passed against her if she changed her version again, as she had done in the past, due to which the youth was jailed for the last three months.

The court reprimanded the woman after she revealed that she had lodged the false case and directed her to file an affidavit regarding her contentions.

The woman, thereafter, filed an affidavit saying the FIR had been lodged under pressure from her husband.

The court sought the affidavit after being informed by the youth’s counsel that although the woman had alleged rape in her statement recorded before a magistrate, her stand had changed at the police station where she had stated that she had been forced by her husband to file the complaint.

Police said the youth, who used to give tuitions to the woman’s children, had established physical relations with her. The court was hearing the bail petition filed by the BCom first-year student who pleaded that he be granted bail as he had never entered into any kind of sexual relations with the woman.

Police opposed his application saying a similar plea had been filed by him in Delhi High Court, which had been dismissed after the investigating officer sought his custody on recovering objectionable photographs and jewellery which he had allegedly taken away from the woman’s house.
