Youth disabled in road mishap gets over Rs 31 L compensation

 A 20-year-old youth, who suffered 100 per cent permanent disability in a road accident involving a rashly driven car in 2011 and is still unconscious, has been awarded a compensation of over Rs 31 lakh by a Motor Accident Claims Tribunal (MACT) here.

The tribunal directed Reliance General Insurance Company Ltd, with which the offending Innova car was insured, to pay Rs 31,60,000 to victim Dinesh Yadav, whose petition was filed through his father as he is unconscious.

"From the testimony of witnesses coupled with documents (FIR, medical report, mechanical inspection report etc), it is established that the petitioner sustained injuries in a road accident on September 24, 2011 at about 4.50 PM due to rash and negligent driving of vehicle by driver," MACT Presiding Officer K S Mohi said.

The tribunal, while awarding the compensation to the victim, observed, "The petitioner was 20 years of age at the time of the accident. Due to the permanent disability, he wouldn't be able to participate in normal activities of his daily life to pursue his talents, recreation interest, hobbies...He will not be able to enjoy marital life."

According to the petition, on September 24, 2011, the victim was coming from Sarojini Nagar market on a motorcycle when suddenly the offending car, being driven in a rash and negligent manner, came from Vijay Raje Schindia Marg side and hit him with a great force.

Due to the impact, he fell down alongwith his motorcycle and received grievous head injuries. He was taken to AIIMS Trauma Center where he remained admitted for over two weeks.

The victim's father got an FIR registered against the driver of the offending vehicle.
The petition said that the youth, who was a student, is in an unconscious state since the day of the accident in 2011.

He was also giving tuitions and earned Rs 10,000 per month, it said, while claiming a compensation of Rs 40 lakh.

The driver and owner of the vehicle did not file any reply in the tribunal but the insurance company confirmed that the vehicle was insured with it.
