The Supreme Court on Wednesday said that appointment of a judge in the High Courts and the apex court cannot be challenged on the ground of suitability of the candidate.
A three-judge bench presided over by Justice B S Chauhan pointed out that only the issues relating to lack of eligibility of a candidate or absence of an effective consultation process can be subjected to judicial review and no petition can be admitted raising questions on the suitability.
