Not natural justice : Justice Soumitra Sen's lawyer

"We had objected to the formation of the committee by the then CJI. He himself was the complainant and he had also appointed the committee. This is not natural justice," Sen's lawyer Subhas Bhattacharya told PTI here.

"We had requested the Vice-President to appoint a fresh committee, but unfortunately it was not done," he said.He also alleged that one of those in the three-member committee, had not been impartial by claiming before the media that Sen was guilty of misappropriation.

"This is not in the interest of fair play," he said."With such foregone conclusions having been made by a member of the committee, the result was expected," he said.
"But there is a long way to go and we will fight against the findings," he said.

He said there was no question of Sen's resignation and had the Justice wished to step down, he would have done so much earlier.

Bhattacharya said a division bench of the Calcutta High Court had found Sen not guilty and had directed deletion of adverse comments against him by a single bench which had found him guilty of misappropriating large sums of money which Sen received as a receiver appointed by the Court."This has unfortunately not been taken in account by the committee," he said.
