Plea against Kodi mutt seer allowed

The property of the three Mutts was maintained by Veerashaiva Samaj till a petition was filed in 1991 by Gurusiddappa. The petitioners in this case sought to remove the trustees and appoint pontiff of Kodi Mutt as president of the Trust, which was upheld by the lower court.

The petitioners submitted that this was a Mutt and not a Trust. However, the appellants moved the High Court challenging the lower court order, which set aside the decree and allowed the appeal.

While disposing of the matter, the Division Bench comprising Justices N Kumar and Venugopalagowda observed that there is no breach of trust as alleged and this would not make a case for removal of trustees.
