Guj govt's denial to prosecute Vanzara, Amin challenged

Shamima Kausar, mother of Ishrat Jahan, has moved special CBI court here in Ahmedabad to challenge the denial of sanction to prosecute ex-policemen D G Vanzara and Narendra Amin. She has requested the court that it should hear her also on the issue of refusal to prosecute the two former accused officers.

The application has been moved through Delhi-based lawyer Vrinda Grover. It says that "The applicant is a poor widow who is vitally interested in the issues raised by the order of the government rejecting sanction for prosecution of two of the accused who have played  direct and prominent roles in the abduction, confinement and murder of her daughter." 

The application states that "The cold blooded murder and branding of her young and innocent daughter  as a terrorist has not only caused irreparable harm to the reputation of her deceased daughter but also continues to haunt and have adverse consequences on the life and livelihood of the widowed applicant, and her children"

Kausar has said in the application that it was following a judicial process "to arraigned as accused these men holding powerful and senior positions in Gujarat police." She has also sought a copy of the government order that has rejected the prosecution sanction. She has said that "refusing sanction for prosecution will result in a grave miscarriage of justice."

It was Shamima Kausar's move to Gujarat high court for probe into the murder of her daughter which led to CBI investigation. The CBI established that her 19 years old daughter Ishrat, her friend Javed Sheikh alias Pranesh Pillai and two alleged Pakisanti nationals Zeeshan Johar and Amjadali Rana were killed in a fake encounter.

In the meanwhile, Vanzara and Amin on Tuesday moved the special CBI court to drop the proceeding against them for want of sanction for prosecuting them under section 197 of code of criminal procedure. Under this section, the government's permission is required to initiate criminal case against government servants.
