The Karnataka High Court on Tuesday sought response from the National Highways Authority of India (NHAI) and the Central government in a petition seeking exemption from toll for advocates and farmers.
A division bench headed by Chief Justice Dinesh Maheshwari was hearing a public interest litigation filed by the Karnataka State Advocates Association Federation. The Federation has approached the high court seeking directions to Central government to consider advocates and farmers as a special category for payment on any toll on national highways under Rule 3 (1) of The National Highways Fee (Determination of Rates and Collection) Rules, 2008.
Amongst various other prayers, the petitioner association has also urged to declare the fixation of toll by the NHAI under the concessionaire agreement as exorbitant, arbitrary, whimsical, having no nexus to the service rendered, in the background of the provisions of the Central Road Cess Fund Act, 2000.
