Produce licence to install transformers: Karnataka HC to Bescom

The Karnataka High Court on Thursday directed Bescom to place on record a copy of the subsisting licence for the installation of transformers on footpaths.

A division bench headed by Chief Justice Abhay Shreeniwas Oka passed the direction after Bescom submitted that no permission is required from local authorities as per the Electricity Act, 2003. The company stated that the newly designed transformers are safe for pedestrians and electrical inspectors have inspected the transformers.

“From the stand taken by Bescom, it appears to us that it is entitled to install transformers on footpaths, forming part of public streets, even without consulting the local authority. With a view to examine the powers of Section 67 of Electricity Act, it is necessary for Bescom to place on record a copy of the licence granted to it,” the court said.

The next hearing has been posted to March 16.

A PIL filed by G B Athri, retired IAF wing commander, said the installation of transformers and laying of cables on roads/footpaths pose grave danger to human lives. The petition said cables of all kinds are hanging haphazardly in the city.
