<p>A Bench of Justices G S Singhvi and H L Dattu also expressed its displeasure over news reports quoting CBI sources as saying that the probe agency would not oppose the bail plea of some of the 2G scam accused, including DMK Rajya Sabha member Kanimozhi. “Some newspapers have reported a statement of the minister. It appears and gives an impression as if we are interested in keeping these businessmen behind bars. Is this news report/statement and what has been reported in newspapers correct? It was in the headline of a leading newspaper. If it is correct, it is disturbing for us,” the Bench said.<br />As soon as Additional Solicitor General H P Raval started his arguments opposing the bail plea of 2G scam accused, the court asked him about the statement and its veracity.<br />Raval, on his part, expressed his ignorance about the statement, but senior counsel Mukul Rohtagi intervened to say that the statement “is correct” and his views were sought in a TV studio debate on the version.<br /><br />Khurshid’s statement in an English daily said putting businessmen behind bars could affect investment. He also reportedly said that judiciary should understand the political economy of the country.<br /><br />The court wanted to know from Raval if he opposed the bail or supported bail applications. Raval said as far as the CBI was concerned, the instruction was to oppose the bail plea. There would not be any deviation on his part.<br /><br />“To say that the CBI is not part of the Central government is a misnomer. Please remember that statement may be a personal remark of a responsible minister. It is surprising for us. Is this the stand of the government,” the court asked.<br /><br />It also referred to the report about CBI having decided not to oppose the bail plea of 2G scam accused, saying “it was inappropriate”.<br /><br />Asserting that the proceedings in the matter would not get affected, the Bench also reminded Raval that there was a public relations department of the government which could have corrected if any news report was wrong.<br /><br />Raval, however, assured the court that he would make clarification after talking to the person concerned in the matter.“It was the best way to go the person concerned,” he said.<br />The hearing on the bail plea will continue on Thursday.<br /></p>
