The complainant, Ziaullah Khan Gori, a merchant from Channapatna, filed an affidavit before the court stating that his complaint with the police had no connection whatsoever with Khan. Gori also affirmed that he never intended to file a case against the legislator and was withdrawing it.

The complainant also contended that the charge sheet filed by the police against Khan was “politically motivated” as he had not mentioned the MLA in his complaint.

In the wake of the affidavit, Justice B V Pinto quashed the charge sheet against Khan on the ground that the complaint filed by Gori with Kengeri police on October 30, 2010, was “concocted.”

The complaint stated that Gori was robbed of Rs 50 lakh. Police had filed the said charge sheet against 13 persons, including Khan, on February 9, 2011.
