Deccan Mining Syndicate had moved the High Court challenging the operation in a leased area by the petitioner and had obtained an order for a survey. The NMDC filed petition before the division bench, challenging the single bench order. The division bench disposed the petition stating that there is no need for a survey.

However, when the respondents (Deccan Mining) allegedly obstructed mining by the petitioner and the Government of India allegedly started making preparations to conduct the survey, the petitioners again moved the High Court seeking injunction.

A division bench, headed by Chief Justice P D Dinakaran, before which the matter is pending, said that the special bench will hear the matter.
