MBA student seeks CBI probe into sexual assault case

The Supreme Court on Monday issued notices to the CBI and the Haryana government after an MBA student complained of sloppy and unprofessional probe into her complaint of repeated sexual assault by her seniors.

A vacation bench of Justices A K Sikri and U U Lalit described the matter as “serious one” and put her petition seeking CBI probe into the case for hearing on Wednesday.

Senior advocate Indira Jaising, appearing for the student of the integrated MBA programme at Jindal Global University, contended that the police had not invoked relevant sections of the Information Technology Act even after the charge against the accused involved using of computer and mobiles. The counsel also sought permission from the court to make the Centre a party to the petition as no cyber expert was appointed as per the law. The petitioner contended that the police acted in a biased manner even after registration of the FIR on April 11.

She claimed that the accused, already arrested, had blackmailed, criminally intimidated and committed rape and unnatural sex over a period of time after obtaining her nude pictures on WhatsApp.  She claimed that one of the accused first befriended her on the campus and then forced her to send her explicit pictures on mobile.

Later, he exploited her and allowed his friends also to join him into circulate the pictures.
She demanded a CBI probe into her complaint as the parents of the accused tried to influence the investigation. The girl also said that the police were quite insensitive and asked her to give specific details about how she was made to consume intoxicating substances before the crime was committed.
