The High Court of Karnataka has ordered notices to the Rajiv Gandhi University of Health Sciences (RGUHS) and the principal of Adichunchanagiri Institute of Medical Sciences, Mandya district, in a petition filed by an MBBS student who has demanded fresh evaluation of a paper in which he failed by just one mark.

Souvik Banik, a third-year MBBS student, failed in the Ophthalmology theory exam by one mark, but cleared all other papers.

During revaluation, the first evaluator gave him 23 marks out of 100 and the second evaluator 50 marks out of 100.

As there was huge difference in the marks, the paper was subjected to third evaluation. He then got 24 marks out of 100. The student later approached the high court.

He argued that the revaluation was “unfair, discriminatory, unreasonable and lacked fair play”.

Pointing to the difference of more than 50% in the marks allotted by the three evaluators, he sought interference of the high court to correct the “illegality” and ensure he got the “correct” score.

He also sought additional marks for answering certain questions in the Ophthalmology paper and that he be permitted to sit for the fourth-year MBBS exams.

Justice P S Dinesh Kumar ordered notices in the matter and directed that the matter be listed before the vacation court.
