Atrocity: Action recommended against police

In his inquiry report submitted to the Commission, the IGP has said Assistant Sub-Inspector of Police N Arasappa, Head Constable H C Vishwanath and Constable Gopinath, all attached Marikuppam police station in KGF  are found to have illegally detained and physical and mental tortured A Babu, a resident of North Gilberts Lane in Marikuppam.

Babu, in his complaint to the Commission had alleged that Arasappa and his staff forcibly took him to police station on March 7 on the pretext of inquiring into a dacoity in the neighbouring house. He was stripped and beaten up. Later on April 4, Babu, his son Suresh and son-in-law Sampath Kumar were illegally detained at the police station till 5 30 in the evening.

Suicide attempt
Deeply hurt by the atrocity and humiliation the three decided to commit suicide. Suresh attempted suicide on April 5 consuming poison. He attributed his attempt to police atrocity while giving statement to in the hospital.

However, the police “instructed” him not to give such statement and didn’t record it, the complaint said.

District Human Rights Centre submitted the complaint to Karnataka State Human Rights Commission chairman S R Nayak, who visited Kolar on May 14. The Commission had directed an inquiry and sought a report before July 19.

The inquiry was conducted by DySP Shivamurthy of Inquiry Department of the Commission. Statements of eight persons and and six affidavits were recorded during the inquiry.

According to the report, a copy of which is available with Deccan Herald, neither Babu or his son or any of his family members have been named in the complaint relating to dacoity.

The involvement of Babu and his relatives in the dacoity has not been established and nor the re-statement of the complainant has been obtained. Furthermore, the three persons have not been cited as offenders in any of the police station within KGF and Marikuppam limits.

Thus, police atrocity on Babu, his son and son-in-law has been established, the report says, recommending action against the ASI and two constables.
