Bengaluru man serves notice to BBMP, seeks Rs 50 lakh compensation for trauma due to bad roads

“My client states that he was forced to visit five orthopaedic specialists due to the intensifying pain,” the notice stated.

Bengaluru: Bengaluru resident has issued a notice to the Bruhat Bengaluru Mahanagara Palike (BBMP) seeking compensation of Rs 50 lakh for the "extreme pain, trauma, and suffering" he allegedly underwent due to poorly conditioned roads.

DH has accessed a copy of the notice dated May 14 by Dhivya Kiran, 43, a resident of Richmond Town, served via his advocate, KV Laveen.

“My client states that, despite being a tax-paying citizen with a right to safe public infrastructure, he has been subjected to continuous physical hardship and mental agony as a result of BBMP's blatant failure to maintain basic civic infrastructure. Specifically suffered severe neck and back pain, which has been medically linked to the jerks and trauma caused while commuting on these treacherous roads,” the notice stated.

“My client states that he was forced to visit five orthopaedic specialists due to the intensifying pain. He made four emergency visits to St Philomena's Hospital, undergoing injections and procedures to relieve acute agony. Further, have been on multiple medications and painkillers to manage the condition. He has also experienced episodes of crying out in pain, loss of sleep, anxiety, and mental distress, all of which have deeply affected his well-being and daily functioning.”

It was further stated that Kiran, due to the road's hazardous condition, cannot travel in auto rickshaws and two-wheelers.

“Even cab rides are difficult, though marginally more tolerable than autos or bikes. This severely limits his mobility and independence, affecting both his personal and professional commitments,” the notice said.

“This is hereby called upon you immediately to make payment total sum of Rs 50 lakh within 15 days from the date of this legal notice to my client, failing which, necessary legal actions and criminal cases will be initiated against you and you are liable to pay all the kinds of expenditures, cost and risk. You are also herby called upon to pay the charges of this legal notice of Rs 10,000”

Kiran also said that the legal action would include a civil suit for damages, a Public Interest Litigation (PIL) in the High Court, and actions with the Lokayukta, the State Human Rights Commission (SHRC), etc.
