Kapil Sibal, appearing for Karnataka Water Resources Minister D K Shivakumar, objected to the submission of enforcement case information report (ECIR) by the Enforcement Directorate (ED) to the Karnataka High Court.

He said ECIR is an internal document and cannot be shared with the court. Even the diary of proceedings of investigation cannot be shared with the court and cannot be used as an evidence, he contended.

To this, the court observed the diary of proceedings can be shared with the court and the judge has the power to look into it.

The court was hearing a petition filed by Shivakumar challenging the prosecution launched against him by the I-T dept for willful tax evasion and filing of false I-T statement. Shivakumar challenged the summons issued on January 17 by assistant director, ED, under the Prevention of Money Laundering Act, 2002, requiring his personal appearance along with documents on February 8. According to him, the entire proceedings against him are without jurisdiction and need to be quashed.

The court adjourned the hearing to Tuesday.
