<p>In a rare judgment, the Second Additional District Consumer Disputes Redressal Forum ordered to pay Rs 10,000 as compensation and Rs 1,000 as cost of the proceedings to a student R Ajay, who was thrown out of a BMTC bus by the driver for no fault of his.<br /><br />The Forum has directed the BMTC to pay both the amount within 45 days from the date of the order. Also, if the BMTC failed to do so within the stipulated time period, it will have to pay six per cent interest per annum on the amount from the date of the order till payment. BMTC also has to pay the amount by DD or cheque to Ajay and inform the Forum about it. Ajay had sought a compensation of Rs 75,000 and Rs 10,000 as cost of court proceedings.<br /><br />Ajay filed complaint against BMTC after he was unceremoniously made to get off the bus in spite of having a pass. Ajay used to travel between Whitefield and Anand Rao Circle and bought the BMTC pass costing Rs 1,570, which is called ‘Travel As You Like.’<br /><br />On birthday<br /><br />On Ajay’s birthday, August 30, 2009, he boarded a Pushpak bus route number 333E, bus number KA 01FA848, which plies between Kadugodi and Majestic bus stand. Ajay was on his way to attend a special class. When the diver-cum-conductor Rajendra Gowda asked him to produce the pass, Ajay showed it to the driver. However, Gowda refused entry to Ajay and said that the pass wasn't valid. Ajay told Gowda that the pass was valid for any kind of bus and asked for Gowda's name and badge number. At this point, Gowda lost his cool and forced Ajay to go out of the bus besides verbally abusing him.<br /><br />The Forum observed that the action of the driver reflected the poor service provided by the BMTC. Also, with the incident happening on Ajay's birthday, it led to shock, mental agony and stress and no amount of compensation would be enough. However, the BMTC had taken action against Gowda and charge-sheeted him. <br /><br />A departmental inquiry is also underway. As Gowda was BMTC employee, it was the responsibility of the latter to recover the compensation amount from Gowda after the departmental inquiry.</p>
