<p>The <a href="https://www.deccanherald.com/tags/karnataka-high-court">Karnataka High Court</a> has stayed proceedings against Malayalam movie director Ranjith Balakrishnan in connection with a 12-year-old sexual harassment case. Justice M Nagaprasanna observed that the complaint, on the face of it, is false since Taj Hotel near Bengaluru International Airport started its operation in the year 2016, while the complainant claimed the incident happened at Taj in 2012.</p><p>The complainant is one Sajeer Cholayil, a resident of Kozhikode, Kerala and the same was registered before the local police. Since the allegation was that the offence took place in Taj Hotel, Bengaluru International Airport in 2012, the case was transferred to BIAL police station. </p><p>The case was for offences under IPC section 377 and section 66 E of the Information Technology Act. It was contended that in the year 2012, the petitioner Ranjith had asked the complainant, an aspiring actor, to meet him at the Taj Hotel. The allegation was that the accused inappropriately touched him as well as had unnatural sex with him on the fourth floor of the hotel building.</p> .MUDA case: Plea in Karnataka High Court seeks to make ED party respondent.<p>The petitioner argued that the complaint contains significant factual inaccuracies, particularly regarding the location of the Taj, which opened for operations only in the year 2016. It was also submitted that the complaint is with a delay of 12 years after the alleged incident.</p><p>“The complaint on the face of it, is false. I don’t even say prima facie, as the Taj Hotel near Bengaluru International Airport starts its operation only in the year 2016, this is in public domain, it is four years after the incident. Therefore, the vivid narration at Taj hotel is absolutely false. </p><p>"This is thus a canard. The complaint is registered in the year 2024 and the alleged incident is said to have happened in the year 2012. Therefore, it has taken 12 years for the complainant to register the complaint. Delay of 12 years is also left completely unexplained. Therefore, on all these factors it becomes a classic case of falsus in uno, falsus in omnibus. Therefore, there shall be an interim order of stay of the investigation and all further proceedings,” Justice Nagaprasanna said.</p>
