<p>Bengaluru: In a relief to BJP MLC C T Ravi, the Karnataka high court on Friday ordered his immediate release. The BJP leader was arrested for his derogatory remarks using unparliamentary words against minister Laxmi Hebbalkar at the legislature. Justice MG Uma observed that prima facie, the police have failed to follow the procedure prescribed by the Apex Court regarding the grounds of arrest.</p><p>“This relief is subject to the condition that the petitioner makes himself available for investigation as and when summoned by the investigation officer,” Justice Uma said in her order. The judge also said, “It is unfortunate that the complainant and the accused are people's representatives and the incident occurred inside legislature at Suvarna Soudha, Belagavi. The provisions have the maximum sentence for three years and as per the orders passed by the Apex Court in Satyender Kumar and Prabir Kumar Purkayastha cases, the police must have shown grounds of arrest in the arrest memo. The police should have also issued a notice under CrPC section 41A or section 35(3) of BNSS, the advocate said.</p><p>On the other hand, State Public Prosecutor Belliappa B A told the court that the petitioner had already moved the special court for elected representatives with a similar prayer, challenging the arrest. However, nothing is placed before the court to satisfy the same…Therefore, a prima facie case is made out for release. Admittedly the petitioner is MLC and absconding does not arise. Therefore, he is entitled to release subject to the condition that he should be available for investigation as and when required,” the court said.</p>
