A bench headed by Chief Justice S H Kapadia threw away the PIL filed by Avishek Goenka who pleaded that holding the elections in winters would help in reducing the problems connected with electronic voting machines.

“You can’t ask us to fix elections programmes. These are all the government matters. We are not supposed to be doing all these things,” the Bench, also comprising Justices K S Radhakrishnan and Swatanter Kumar, said.

According to the petition, since normal time span to conduct elections is 30 days – the period between January 16 and February 15 is a favourable time to hold elections as the plains experience spring like weather in January and the ice melts in February.

Alternatively, the same holds good for the period between November 16 and December 15, since in November, there is no snow in the hills and in December plains are comfortably cool, it said.
