Manipur Governor to decide soon on disqualification of 12 BJP MLAs, SC told

The court had observed that the Manipur Governor cannot skip conveying his decision on the recommendation made by the ECI

The Supreme Court was on Thursday told that Manipur Governor will take a decision soon on Election Commission's opinion on disqualification of 12 BJP MLAs in the office-of-profit matter.

A bench presided over by Justice L Nageswara Rao told Solicitor General Tushar Mehta that he should use his good offices in the matter.

“According to Article 192 (of Constitution), the Governor has to go with the decisions. In 11 months, nothing has happened. We don't want to pass an order, but please your good offices so that opinion is given so that it can be challenged,” the bench, also comprising Justices B R Gavai and B V Nagarathna, said.

Mehta, for his part, responded by saying, "I assure we'll do something and no direction will be required to be passed”.

On November 9, the court had agreed to a contention that the Manipur Governor cannot skip conveying his decision on recommendation made by the Election Commission on January 13, 2021 on disqualification of 12 BJP MLAs on issue of office-of-profit.

The top court was hearing a writ petition by a Congress MLA from Manipur Assembly, D D Thaisii, for disqualification of 12 BJP MLAs on the ground of holding post of Parliamentary secretaries which amounted to office of profits.

Senior advocate Kapil Sibal, appearing for the petitioner, had then said that the constitutional authority cannot keep the decision pending. He said just one month remained for expiry of the term and everything would be over by then.
