The Supreme Court on Monday agreed to consider a plea filed by the Union government to transfer separate PILs that challenged the imposition of GST on sanitary napkins before different high courts, to the apex court.
A three-judge bench of Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud posted the transfer petition filed by the Centre for consideration on January 22.
Additional Solicitor General Pinky Anand and senior advocate V Mohana, representing the Union government, submitted that two separate PILs – before the Delhi and Bombay High Court – have been filed in the matter, that should either be transferred to one high court or to the apex court.
A Mumbai-based NGO Shetty Women Welfare Association has challenged the imposition of 12% GST on sanitary napkins before the Bombay High Court that has issued a notice to the Union government.
A similar PIL was earlier filed before the Delhi High Court.
