Tax authorities have served a demand notice of Rs 11,217.95 crore ($2.5 billion) on Vodafone treating it as a defaulter as capital gain tax at a rate of 11.33 per cent, along with surcharge and education cess on non-listed securities, was not paid.
The matter will come up before a three-judge bench headed by Chief Justice S H Kapadia.
