Dismissing a petition challenging the ordinance, Justice Ashok B Hinchigeri, granted liberty to the petitioner to approach the state government seeking more representation to politically most backward classes among the Backward Classes.
“It is not fair to neglect the most backward classes which have gone without representation in the local self government. If the state cannot identify them, the elections will go on as per the new ordinance,” the court observed and said that the order will not come in the way of calendar events for the poll.
Referring to the Supreme Court order on the issue, the Judge said that apex court order was the rule of the land and he cannot interfere with it.
The Court said the entire process of elections should begin from December 10 and completed before January 15, 2011.
