Asnotikar, in his petition, had said that the withdrawal of denotification came after he wrote to the Governor withdrawing support to Yeddyurappa government on October 6, 2010.
Terming the action as vindictive, the petitioner said there was no justification for cancellation. He had claimed that the government had no authority to do so, and sought to quash the BDA order. The BDA had acquired two acres, 37 guntas of land from Gujappa (survey number 109) of Mattikere village way back in 1978.  However the 37 guntas of land was returned.

Asnotikar and others had purchased the 37 guntas on Nov 25, 2009. The Government has denotified the said land on December 30, 2009 in favour of the petitioner. Justice B V Nagarathna  stayed the order.
