Intemperate remarks draw apex court's ire

A Bench of Justices B Sudershan Reddy and S  S Nijjar disapproved the ‘extravagant’ words used by the high court’s two-judge Bench and set aside its order.

The HC had used rough language in a judgment and condoned delay of 3,703 days in a civil suit appeal.

 “We are rather pained to notice that in this case, not being satisfied with the use of mere intemperate language, the High Court resorted to blatant sarcasms. The use of unduly strong intemperate or extravagant language in a judgment has been repeatedly disapproved by this Court in a number of cases,” the apex court stated.

The Bench said that the HC had gone overboard in criticising the government officials.
“In its desire to castigate the government pleaders and the Court staff, the High Court has sacrificed the ‘justice oriented approach’, the bedrock of which is fairness and impartiality,” it stated.

The apex court asked all judges to adhere to the principles of objectivity and impartiality to do justice without any prejudice, fear, favour or ill-will.
