CWG scam accused move court against property attachment

Businessmen A K Madan and Purshottam Arya, promoters of Faridabad-based Gem International to which a Swiss firm had given the sub-contract to install Timing Scoring and Result systems for the Games, told Special CBI Judge Talwant Singh in their plea that police has initiated steps to attach their properties despite the court's order not to do so.
They pointed out to the court that it had ordered attachment of their properties before they had surrendered before it for their alleged role in the scam, but after they gave themselves to the court, the order for attachment of their property had been stayed.
The two businessmen said that despite the court having directed CBI not to go further with the process of attaching their immovable assets, the Haryana police officials visited their residences to affix their properties.

"Issue notice of this application to the investigating officer through senior public prosecutor as well as Commissioner of Police, Faridabad," the court said while seeking their response by September 8. Madan and Arya, who were declared proclaimed offenders, had surrendered before the court on August 16 after which the judge had directed the CBI not to attach their immovable properties further.

"On August 16 itself, this court directed the CBI not to execute the process of attachment of immovable properties of Madan and Arya if not executed till August 16," said Ghanshyam Sharma, the counsel for the two businessmen.

He further said when his clients' families apprised the Haryana Police about the court order, the officials replied that they have not received any such order.

Madan and Arya's Gem International was a sub-contractor of Swiss firm 'Swiss Timing' which was allegedly illegally granted the Timing, Scoring and Result (TSR) system contract causing a loss of over Rs 90 crore to the exchequer.

Besides, Madan and Arya, seven persons including six former officials of CWG Organising Committee are accused in the TSR scam with its sacked chairman Suresh Kalmadi and are presently lodged in Tihar Jail.

Besides them, two companies--Swiss Omega Timing and AKR Constructions--are also accused in the case.

The CBI, in its charge sheet filed on May 20, had said that Madan and Arya knew Kalmadi much before the Games and they had allegedly used their links with him in securing the lucrative contract for Swiss Timing Omega.
