A three-judge bench headed by Altmas Kabir decided to hear the matter as senior counsel Ranjit Kumar and Mukul Rohtagi claimed that the courts were denying the accused bail against the judicial dictum - bail is rule and jail an exception.
Kumar said that the courts were not allowing bail plea of the accused in high profile cases attracting undue media interest.
Media was pre-judging the cases and trying to influence the conduct of judges, who were also wary of adverse confidential reports being filed against them, he said. The 2G spectrum allocation scam is an example wherein at least eight high-profile accused, including DMK MP Kanimozhi, are in jail after repeatedly being denied bail even after charges were framed against them.
