Courier co to pay Rs 2 lakh for lost goods

A district consumer forum here has asked a courier firm to pay Rs 1.75 lakh to a customer as the value of his lost goods, apart from a compensation of Rs 25,000 for its “deficiency in service”.

The District Consumer Disputes Redressal Forum (Central) directed courier firm Express Solutions to compensate the customer for the harassment he suffered due to failure by the firm “to provide requisite services”.

“It amounts to deficiency in service due to which the complainant has suffered financial losses beside harassment, pain and mental agony,” the panel said while directing the firm to also pay Rs 5,000 as litigation expenses to the complainant, Bheem Khattar.

It further directed the firm to pay an interest of 9 per cent on the amount of Rs 1.75 lakh from date of booking, which was in 2008, till the amount is realised.

Khattar, who runs an IT services firm in South Delhi, contended that he had sent computer parts worth Rs 1.75 lakh to a company at Kochi through Express Solutions.

The material dispatched through courier did not reach the destination, following which he had to dispatch a fresh set of computer parts.

The courier firm argued that it was unable to deliver the goods because they couldn’t be unloaded at Kochi and was later seized by the Sales Tax Department at Trivandrum railway station.

The panel headed by B B Chaudhary also rejected the plea that Khattar was not a consumer under the Consumer Protection Act.
